What is an employment grievance?

An employment grievance — formally called a personal grievance — is a complaint by an employee that they have been treated unjustifiably by their employer. It is the primary mechanism for employees to seek redress under the Employment Relations Act 2000.

Types of grievances

The most common grievances are unjustified dismissal, unjustified disadvantage (being treated unfairly without being dismissed), discrimination, sexual harassment, racial harassment, and constructive dismissal (being forced to resign).

Raising your grievance

To raise a grievance, you must notify your employer within 90 days of the dismissal or action you are grieving. The notification doesn't need to be formal — but it must make clear that you consider yourself to have a grievance.

The resolution process

After raising a grievance, the parties typically attempt to resolve it through mediation. A trained mediator facilitates the discussion. If mediation is unsuccessful, the matter proceeds to the Employment Relations Authority.
